This Colorado case gives us the opportunity to detail one of the ways the current occupiers of the RNC have conspired with the media to obscure important details about the various state delegate selection processes.
The primary nomination process the RNC has crafted in cooperation with state Republican parties violates the First Amendment rights of all Republicans by:
Allowing non Republican voters to participate in the delegate selection process.
Allowing candidates to hand pick delegates.
Mandating “binding” delegates to vote according to results of primaries.
The current occupiers of the Republican National Committee have knowingly violated the Rules of the Republican Party and deprived Republicans everywhere of their right to govern the party by falsely imposing a requirement for all state parties to “bind” or “pledge” delegates to the results of primaries or caucuses.
This has been accomplished by coercing state parties to include “binding” in their required submission of delegate selection plans for the 2024 Republican National Convention. (The RNC has refused to provide completed Rule 16 filings for both 2020 and 2024)
The Associated Press is the premier spreader of the BIG REPUBLICAN PRIMARY LIE!
The not so subtle “horse race” characterization of primaries is a staple in the Associated Press coverage of the primaries.
Effectively, this creates the illusion that the primary “horse race” ultimately results in a single winner, or presumptive nominee, even before most of the delegates have even earned the right to be a delegate. (Ever seen a “horse race” with multiple winners?)
Without shame, they routinely ignore any reference to available facts that lead to the conclusion that the Republican National Convention owns the exclusive right to nominate the Republican candidate for President of the United States.
Here is an example of the reckless behavior of the AP. This false rhetorical question headlined the AP story from an RNC release announcing the Rule 16 filings for 2024.
“What if Donald Trump is convicted? The 2024 Republican convention rules don't address the issue”
NEW YORK (AP) — The Republican National Committee’s rules for next year’s nominating contest and convention were released this week without addressing a question the GOP could well face next summer: Can the party’s delegates vote for a different candidate if the presumptive nominee is convicted of a felony?

That AP story generated an article in The Intelligencer where the author, Ed Kilgore, took the liberty to defame me!
Kilgore writes:
“Is there a way to unbind them? Well, Republicans went through a bit of a test of this question the first time Trump ran for president, in 2016, when longtime party heretic Curly Haughland of North Dakota got a lot attention from NeverTrump Republicans with his argument that delegates inherently enjoy the right to vote their consciences at conventions notwithstanding national or state party rules binding them to candidates via primary or caucus results. There was an actual effort at the RNC in Cleveland in July to formally unbind the delegates during deliberations of the convention’s rules committee. It failed, predictably, and then failed definitively after a voice vote to accept the rules on the convention floor.”
This December 1 piece by Mr. Kilgore would just be an insult except that it is based on false information.
I was a member of the Republican National Committee Rules Committee that actually voted to “bind” the delegates!
I have the complete transcript of the 2016 Convention Committee meeting to prove it!
Therefore, Ed’s use of the term “heretic” not only defames me personally; it also advances the BIG REPUBLICAN PRIMARY LIE that depends on the false information that delegates to the Republican National Convention are bound PRIOR TO the Convention.
In other words, just as it was true in 2016, delegates to the 2024 Republican National Convention will remain UNBOUND unless and until a majority of the Republican National Convention delegates in 2024 vote to BIND themselves as they did in 2016.

The only recourse for Republicans is civil rights litigation to enjoin the Secretaries of State from conducting “binding” primaries.
Without “binding delegates” the Republican National Convention can determine if other practices the RNC has imposed on states are compatible with the their wishes when the Rules of the Republican Party are adopted by the 2024 Republican National Convention.
Now is the time for all good persons to come to the aid of their Republican Party!
